Terms of Service - Dossis Digital

These are the terms on which Dossis Digital (ABN 50 140 793 623) ('we', 'us', 'Dossis') provides its marketing services. 'You' or 'the Client' means the business that accepts these terms by paying for a plan.

By ticking 'I agree' at checkout and making your first payment, you accept these terms. Your acceptance, the date, and your business details are recorded by our payment provider (Stripe). No physical signature is required.

Our plans and what they include

We offer three plans, billed weekly:

Spark ($100/week): a professional website built and hosted for you with basic on-page SEO, Google Business Profile setup and optimisation, Bing and Apple Maps listings, weekly Google posts, automated review generation and review responses, small site changes, hosting, security, backups, updates and uptime monitoring, enquiry alerts, monthly reporting and text support. Spark is a presence plan and does not include ongoing SEO work or managed ads.
Growth ($250/week): everything in Spark, plus a larger website with a page per suburb and service, one managed ad account (Google, Meta, TikTok or LinkedIn; ad spend billed separately at cost), ongoing SEO, AI-search visibility, conversion and call tracking, lead follow-up automation, and a live reporting dashboard.
Domination ($450/week): everything in Growth, plus management of all your ad accounts (Google, Meta, TikTok and LinkedIn), database reactivation, retargeting, an ongoing content and authority programme, a custom lead-capture tool, and a monthly strategy call.

Your exact scope is confirmed in writing at your onboarding kickoff.

What we need from you

To deliver your plan (and, on Growth and above, to honour the guarantee below), you agree to:

provide access to your accounts (Google Business Profile, domain, hosting, and ad accounts where relevant) within 7 days of kickoff;
supply requested brand assets, photos and business details within 14 days of kickoff;
respond to our requests within 5 business days;
on plans that include ads, maintain the agreed ad budget and not pause campaigns without agreement.

Delays on your side may push out timelines.

Payment

Fees are billed weekly in advance by direct debit (Stripe BECS), starting on your start date. There is no lock-in and no minimum term.

Spark has no setup fee. Growth and Domination include a one-off setup fee of $1,500 + GST, payable before work begins and non-refundable once work has started.

All fees are plus GST (Dossis is GST-registered). Where ads are included, ad spend is separate and paid straight to the platform at cost, with no markup.

Term and cancellation

No lock-in and no minimum term. Either party may cancel at any time with 30 days written notice. Fees already paid are non-refundable and the final period is payable. Any setup fee is non-refundable once work has begun.

Cancelling may affect who owns the website and branding, depending on your plan and timing. See the next section.

Ownership of what we build

Your domain name, and any accounts registered in your name, always remain yours. We retain ownership of our underlying tools, templates, systems and know-how.

On Spark, your website (and any logo or branding) is built for free. Because of that, these Dossis Digital-built assets remain our property until you have completed 26 weeks (six months) of continuous active paid membership from your start date. If you cancel before then, the website is taken offline and the source files and formal transfer of intellectual property in the logo and branding are withheld, unless you keep everything by paying a one-off buy-out fee of $1,500 + GST. After 26 weeks, they are yours to keep.

On Growth and Domination, the setup fee covers your build, so the website, logo and branding are yours from the day we deliver them, and remain yours if you later leave. If we have waived the setup fee, the build is provided free, and the same 26-week rule as Spark applies.

Realistic expectations

SEO and advertising results take time and depend on factors outside our control, including Google's algorithms, competitor activity and market demand. We do not guarantee specific rankings, lead volumes or revenue beyond the written guarantee below. We commit to the work and to acting in your best interests.

Confidentiality

Each party keeps the other's private business information confidential and uses it only to deliver these services.

Liability

Our total liability under these terms is limited to the fees you paid in the month in which the issue arose. We are not liable for indirect or consequential loss, or for the actions of third-party platforms (Google, Meta, hosting providers). Nothing in these terms excludes rights you have under the Australian Consumer Law that cannot lawfully be excluded.

Offboarding

On cancellation we hand over your website access and data (subject to the ownership section above), and deliver any work paid for to the end of the paid period.

The guarantee (Growth and above)

Where we control your website and lead conversion (Growth and above), we promise: you get 5 real leads in 90 days, or we work free until you do, plus a $500 cheque if we still have not got you there.

What counts as a lead: tracked lead events (form submissions) plus defined soft conversions (call, email and SMS clicks), measured on your performance dashboard, which is the single source of truth.
Window: 90 days from go-live (site and campaigns live), not from signup.
Conditions: you met your obligations above (access, assets, responses, ad budget maintained, campaigns not paused) and there was no major business change (closed, rebranded, stopped taking the work, or at capacity and turning leads away).

How you accept these terms

By ticking 'I have read and agree to the Service Agreement' at checkout and making your first payment, you confirm you have read, understood and agree to these terms. The date of your acceptance and your business details are recorded by Stripe. No physical signature is required.

Governing law

These terms are governed by the laws of Victoria, Australia.
